Terms of Service

Welcome to Best Boston Car Service (BBCS)! By accessing our website or booking our services, you indicate your understanding and agreement to be bound by the following terms of service (TOS), acceptable use policy (AUP), and privacy policy (PP). Please read them carefully before using our website or making a reservation.

General Terms

  • BBCS provides luxury transportation services within the Greater Boston area, ensuring a safe and comfortable experience.
  • All rates, fees, and surcharges are subject to change without prior notice. The current rates can be found on our website or obtained by contacting our customer service.
  • To make a reservation, you must provide accurate and complete information, including your name, contact details, pick-up location, drop-off location, and billing information.
  • We require a valid credit card to secure your reservation. Credit card information will be securely stored and utilized as per our privacy policy.
  • All passengers must comply with local laws and regulations while using our services.

Cancellation and No-Show Policy

  • To cancel a reservation without incurring a cancellation fee, you must notify BBCS at least 24 hours prior to the scheduled pick-up time for standard reservations.
  • Cancellations made within 24 hours will be subject to a cancellation fee equivalent to the full fare plus a 20% gratuity charge.
  • No-shows (passenger fails to appear at the designated location) will be subject to a no-show fee, including the anticipated trip cost, applicable service fees, wait time charges, and a 20% gratuity.
  • If you cannot locate your driver, please contact our customer service helpline at least 15 minutes prior to the scheduled pick-up time to avoid a no-show fee.

Payment and Billing

  • Payment for services rendered will be processed through the credit card attached to your account at the completion of the trip, unless prior arrangements have been made.
  • We accept major credit cards, including American Express, Discover Card, MasterCard, and Visa.
  • Invoices will be billed based on the actual service provided, including applicable extra charges, tolls, airport fees, parking fees, and additional waiting time, if applicable.
  • Upon request, a detailed invoice will be provided for all transactions.

Arbitration Clause

  • Any dispute arising out of or relating to these terms of service, the use of our services, or any other related matter shall be resolved through binding arbitration, to be conducted in accordance with the American Arbitration Association (AAA) rules.
  • The arbitration shall take place in Massachusetts, and the laws of the State of Massachusetts shall govern the arbitration proceedings.
  • The prevailing party in any arbitration or litigation is entitled to recover attorneys' fees and costs incurred in connection with such proceedings.
  • By accepting these terms, you waive your right to participate in a class action lawsuit or class-wide arbitration.

Liability for Damage to the Vehicle

  • The client assumes full responsibility for any damage caused to the vehicle during the duration of their reservation. This includes but is not limited to spills, stains, burns, or any other damages caused by the client or their guests.
  • In the event of any damage, the client will be responsible for covering the cost of repair or replacement of any damaged items.

Indemnification

  • The client agrees to indemnify and hold Best Boston Car Service (BBCS), its employees, and affiliates harmless from any claims, damages, or liabilities arising out of their use of BBCS services.
  • The client agrees to reimburse BBCS for any costs incurred, including legal fees, in defending any claims or actions brought against BBCS pertaining to the client's use of services.

Passenger Conduct

  • The client and their guests are expected to behave in a respectful and appropriate manner during their reservation. Any inappropriate behavior, including but not limited to harassment, intoxication, or causing a disturbance, may result in immediate termination of the reservation with no refund.
  • BBCS reserves the right to refuse service or remove any passengers who are deemed to be a threat to the safety and well-being of the chauffeur or other passengers.

Force Majeure

  • BBCS shall not be held liable for any delays, service disruptions, or failures to perform its obligations due to circumstances beyond its control, including but not limited to acts of God, natural disasters, strikes, labor disputes, governmental actions, or terrorism.
  • In such cases, BBCS will make every effort to notify the client and provide alternative arrangements if possible.

Insurance

  • BBCS maintains comprehensive insurance coverage for its vehicles and passengers. However, clients are encouraged to carry their own personal travel insurance for any valuables or personal possessions.

Governing Law and Jurisdiction

  • These terms of service shall be governed by and construed in accordance with the laws of the State of Massachusetts. Any legal action or proceeding arising out of these terms shall be brought exclusively in the state or federal courts located within Massachusetts. 

Limitation of Liability

  • BBCS shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or personal injury, arising out of or in connection with the use of our services.
  • BBCS will not be liable for delays or failures to provide services caused by events beyond our control, including traffic conditions, accidents, severe weather, or any other unforeseen circumstances.

Termination of Service

  • BBCS reserves the right to refuse or terminate service to any individual or group at our discretion.
  • We also reserve the right to modify, suspend, or terminate our services or website, in part or in whole, without prior notice. 

Modification of Terms

  • BBCS reserves the right to modify these terms of service at any time. We will notify clients of any changes and provide the updated terms on our website.
